Das Thema "Zustimmungsfiktion" beschäftigt Finanzdienstleister seit dem BGH-Urteil vom 27.4.2021. Damals wurden die entsprechenden Klauseln für unwirksam erklärt, denn "𝐒𝐜𝐡𝐰𝐞𝐢𝐠𝐞𝐧 𝐢𝐬𝐭 𝐤𝐞𝐢𝐧𝐞 𝐙𝐮𝐬𝐭𝐢𝐦𝐦𝐮𝐧𝐠." 🤫 Die AGB-rechtlichen Vorgaben für solche Klauseln betreffen letztlich alle Dauerschuldverhältnisse, in denen der Verwender Änderungen an den Vertragsbedingungen und Entgelten über AGB herbeiführen möchte.
